今年唐獎法治獎得主 Bruce Ackerman 教授的大作 We the People 系列,應該是名滿天下。他的得獎完全實至名歸。
We the People 所提的「憲法時刻」、「雙元民主」概念,從美國制憲、行憲的歷史,導出一套憲法基礎理論的宏觀論述。一方面回答了「司法審查反民主嗎」的問題,同時也讓憲法理論跳出「司法語言」的框架---憲法的規範與意涵,不該只交給法院來界定,而是「全民」的民主運動。
Ackerman 細說制憲、內戰,以及二十世紀民權運動的美國政治社會法律史,從中導出「人民(We the People)形成憲法規範」的憲法論述;同時也挑戰司法至上(甚至獨佔)的憲法論調。
他也檢討(在美國當時也甚囂塵上的)monism 以及 rights foundationalists:前者是認為只有國會立法有正當性,這樣一元民主就好了(許多政治學者採取類似看法,認為美國若採內閣制會更好;也有憲法學者認為不要有司法審查,或是大幅限縮司法審查權);後者則是把「個人權利」拉到最高地位(類似德國基本法那樣),認為民主就該對人權讓步。而Ackerman 卻是把「民主」拉到最高,而且超越國會、權利、司法、總統,而是「全體人民」的自我規範。司法審查在這個架構下,也就只是履行「全民在憲法時刻發動的憲法革命所訂下的成果」。
前幾年我也曾在研究所的「英文法學名著選讀」挑了第三卷「民權立法」編來給同學們讀。裡面有無數的歷史故事,從中可以看到社會主流的公共價值如何形成、轉變、建構、鞏固。這都不是看著條文或判例就能懂的。
保守派一直要把憲法解釋拉回「歷史傳統」,Ackerman 則是一個比保守派憲法學者更「歷史」的政治哲學與憲法大師。前陣子聽陳愛娥老師說,她正在讀這個系列(當時已經讀到第三卷了),並且有許多的心得。可見「憲法史」不只是修憲的繁瑣過程,更是憲法成長的背景脈絡理解。看過這些歷史介紹,對於那個時代為什麼會有那些判決、爭議、學說,我們才會稍有認識。
可悲的是,我們別說回頭去看制憲史了,連解嚴前後的過程,以及臺灣民主化至今的諸多事件,都只剩下非常狹隘的片面解讀。讓我這個「解嚴之子」(解嚴時剛好讀大學)實在看不下去。至於法律研究與司法判決,更幾乎都不引用、參考憲法成長的歷史,真是很悲哀。(許多人滿口德國美國學理判例,但說到張君勱、制憲國大,卻極為陌生......)
