Denmark has proposed an innovative amendment to its copyright law to combat the rising threat of AI-generated deepfakes, which create highly realistic but fake representations of people's appearances, voices, or actions.
Announced by the Danish government under Culture Minister Jakob Engel-Schmidt, the bill aims to grant every citizen exclusive rights—similar to copyright ownership—over their own face, voice, body, and overall likeness.
This approach treats personal identity elements as protected intellectual property, addressing gaps in existing privacy or personality rights laws that fail to adequately shield individuals from generative AI misuse.
The legislation would prohibit the unauthorized creation and especially the dissemination of deepfakes without explicit consent, defining them as realistic digital imitations.
Affected individuals could demand immediate removal of such content from online platforms, with potential fines for non-compliant companies like social media giants.
Exceptions may apply for parody or satire, though details remain under discussion. The proposal, backed by broad cross-party support, positions Denmark as a European pioneer in digital identity protection and could influence broader EU efforts.
By framing personal features as ownable assets, the law seeks to empower citizens against scams, misinformation, non-consensual pornography, and reputational harm in an era where AI can clone identities from minimal data.
